If you agree to take the test and your BAC is .07 or less, you will be charged with driving while impaired, which is a misdemeanor charge. If your BAC is .08 or higher, you will be charged with driving under the influence, also a misdemeanor charge.

Note: Typically, you will be charged with both DUI and DWI for a BAC of .08.

In addition to fines, jail time and the threat of points on your license or losing your license, DUI/DWI charges also carry the threat of installation of an ignition interlock device. You may also be required to attend a motor vehicle administration (MVA) hearing or more serious litigation.
